K-1ビザってなに？

いつかまとめておこうと思っていた、K-1ビザ（フィアンセビザ）からグリーンカード（永住権）取得までのプロセスを徐々に書いておこうと思います。弁護士を雇わなくても、正確な情報で手順に沿ってやれば必ずできます。

K-1ビザってなに？

The fiancé(e) K-1 nonimmigrant visa is for the foreign-citizen fiancé(e) of a United States (U.S.) citizen. The K-1 visa permits the foreign-citizen fiancé(e) to travel to the United States and marry his or her U.S. citizen sponsor within 90 days of arrival. The foreign-citizen will then apply for adjustment of status to a permanent resident (LPR) with the Department of Homeland Security’s (DHS) U.S. Citizenship and Immigration Services (USCIS). Because a fiancé(e) visa permits the holder to immigrate to the U.S. and marry a U.S. citizen shortly after arrival in the United States, the fiancé(e) must meet some of the requirements of an immigrant visa. Eligible children of K-1 visa applicants receive K-2 visas.

要するに、K-1っていうのは非移民ビザの１つで、アメリカ国籍を持たない人がアメリカ人と結婚しようとする時に申請するビザ。だから、K-1ビザを取得してアメリカに入国したら、９０日以内にアメリカ国籍をスポンサーしてくれる人（結婚する相手）と結婚してくださいというルール。そしたら永住者(Permanent resident)にステータス切り替えてね、となるので最終的に永住権（グリーンカード）が貰えるのです。

で、よく質問に出たのが、

K-1、K-2、K-3、K-4の違いは？

• K-1 -- アメリカ国外に居て、法的に相手と結婚してない人
• K-2 -- K-1の対象者の子供
• K-3 -- アメリカ国外に居て、法的に相手と結婚してる人
• K-4 -- K-3の対象者の子供

K-1ビザの有効期限は？

• 発行されてから６ヶ月

K-1ビザの期限が切れた場合どうなる？

• 申請のやり直し

Treatment of I-129F petitions where the Department of State (DOS) refuses to issue the K-1 visa and returns the expired petition to USCIS.Once USCIS receives a consular returned I-129F for K-1 classification from DOS and the petition has expired in accordance with 8 CFR214.2(k)(5), USCIS will allow the petition to remain expired and will not reaffirm or reopen the petition.  Therefore, the petition will expire in normal course.  Please note that this will not preclude the petitioner from filing another petition.

アメリカに入国して９０日経っても結婚しなかった場合？

• アメリカ国外に退去してください。しなかったら強制送還されて後々の申請に影響が出る

What happens if we do not marry within 90 days?Fiancé(e) status automatically expires after 90 days. It cannot be extended. Your fiancé(e) should leave the United States at the end of the 90 days if you do not marry. If your fiancé(e) does not depart, he or she will be in violation of U.S. immigration law. This may result in removal (deportation) and/or could affect future eligibility for U.S. immigration benefits.

K-1ビザってどれぐらいで発行されるの？

• 正直なところ、ネットで進捗確認できるけども、役所がどれだけ早く処理するかなので不明。（半年以上かかったような記憶が。。）
